1.  INTRODUCTION

These Terms & Conditions govern the use of the Ballistic Guns & Ammo website, including the browsing of the website, submission of enquiries, placing of orders, purchasing of products, payment, collection and/or delivery of firearms, ammunition, firearm accessories and other products offered by Ballistic Guns & Ammo ("Ballistic", "we", "us" or "our").

By accessing or using this website, you acknowledge that you have read, understood and agreed to be bound by these Terms & Conditions.

Where applicable, all sales and transactions are subject to the Firearms Control Act 60 of 2000, the Firearms Control Regulations, applicable South African legislation, and any amendments or regulations applicable at the time of the transaction.

2.  REGULATED PRODUCTS

Certain products offered by Ballistic Guns & Ammo are regulated under South African law. These include, but are not limited to:

        Firearms;

        Ammunition;

        Firearm components and parts where regulated;

        Certain firearm-related accessories; and

        Any other product which may be subject to statutory restrictions.

The availability of a product on the website does not mean that the product may be lawfully purchased, possessed, transferred, imported, transported or used by every customer.

All regulated-product transactions are subject to applicable legal requirements and Ballistic's verification and approval procedures.

3.  CUSTOMER ELIGIBILITY

Customers purchasing regulated products must be legally entitled to acquire, possess and/or use the relevant product.

Ballistic reserves the right to request documentation and information necessary to establish a customer's eligibility and compliance with applicable legislation.

For firearm purchases, the customer may be required to provide, where applicable:

        Valid identification documentation;

        Proof of address;

        A valid firearm licence or other required authorisation;

        Competency documentation;

        SAPS documentation;

        Relevant permits or authorisations;

        Any additional documentation required by law or by Ballistic; and

        Any information reasonably required to complete the prescribed transaction and compliance checks.

Ballistic may refuse or place an order on hold where the required documentation is incomplete, invalid, expired, inconsistent or cannot be satisfactorily verified.

4.  FIREARM PURCHASES

A firearm displayed on the website is not transferred to the customer merely because an order has been submitted or payment has been made.

A firearm may only be released or transferred once all applicable legal and regulatory requirements have been satisfied.

Where applicable, the customer must obtain the required firearm licence and/or authorisation before the firearm can be lawfully released into the customer's possession.

Ballistic will not release a firearm to a customer where the required legal documentation or authorisation has not been obtained or verified.

The customer acknowledges that processing times for firearm licences and related applications may be determined by SAPS or other authorities and are outside Ballistic's control.

5.  AMMUNITION PURCHASES

The purchase and possession of ammunition are subject to South African law.

Customers purchasing ammunition must satisfy all applicable legal requirements and may be required to provide proof of lawful entitlement to possess the ammunition.

Ballistic reserves the right to verify the customer's firearm licence, competency documentation, identification and any other documentation required before releasing ammunition.

Ballistic will not knowingly supply ammunition where the transaction would contravene applicable legislation.

6.  ONLINE ORDERS

Submitting an online order constitutes a request to purchase the selected product and does not automatically constitute final acceptance by Ballistic.

Ballistic reserves the right to:

        Accept or reject an order;

        Request additional documentation;

        Conduct compliance and verification checks;

        Place an order on hold;

        Cancel an order;

        Correct pricing or product information errors;

        Refuse a transaction where required by law; or

        Refuse a transaction where Ballistic reasonably believes that the transaction cannot lawfully or safely be completed.

For regulated products, an order will only proceed to completion once all required compliance requirements have been satisfied.

7.  PAYMENT

Payment must be made using a payment method made available and approved by

Ballistic.

Payment does not override any legal requirement relating to the purchase, possession or transfer of a regulated product.

Where payment has been received but a regulated transaction cannot legally be completed, Ballistic will deal with the payment in accordance with its applicable refund and cancellation policy, subject to any lawful deductions or costs that may apply.

Ballistic reserves the right to conduct payment verification and fraud-prevention checks.

8.  PRICING

All prices displayed on the website are subject to change without notice.

Unless specifically stated otherwise, prices may be subject to applicable VAT, delivery charges and other applicable fees.

Ballistic reserves the right to correct genuine pricing, typographical or productdescription errors.

If an incorrect price has been displayed, Ballistic may contact the customer before processing the order and provide the option to proceed at the correct price or cancel the order.

9.  PRODUCT AVAILABILITY

Products displayed on the website are subject to availability.

A product appearing as available online does not guarantee that the product will remain available until the customer's order has been verified and accepted.

Where a product becomes unavailable after an order has been submitted, Ballistic will contact the customer regarding the available options.

10.  FIREARM LICENCE APPLICATIONS

Where Ballistic assists a customer with a firearm licence application or related administrative process, such assistance does not constitute a guarantee that a licence or other authorisation will be granted.

The decision to grant or refuse a firearm licence or authorisation rests with the relevant authority.

Ballistic is not responsible for delays, refusals or decisions made by SAPS or any other governmental authority.

11.  DELIVERY AND COLLECTION

Regulated products may only be delivered, transported or collected in accordance with applicable South African legislation and any requirements imposed by the relevant authorities.

Ballistic may require the customer to collect certain regulated products from an authorised premises or use an appropriately authorised transportation or delivery service.

A customer may be required to present original identification and/or other documentation upon collection.

Ballistic will not release a regulated product to a person who cannot satisfactorily establish their identity and legal entitlement to receive the product.

Delivery times provided by Ballistic are estimates and may be affected by regulatory approvals, documentation, stock availability, transportation requirements and circumstances outside Ballistic's reasonable control.

12.  AGE AND IDENTITY VERIFICATION

Ballistic reserves the right to verify the age and identity of customers where required by law or reasonably necessary for the transaction.

Customers must provide truthful and accurate information.

Providing false, misleading, fraudulent or altered documentation may result in cancellation of the transaction and may be reported to the appropriate authorities where required or permitted by law.

13.  FRAUD AND MISUSE

The website may not be used for:

        Fraudulent transactions;

        Attempting to circumvent firearms legislation;

        Purchasing regulated products on behalf of a person who is not legally entitled to possess them;

        Providing false or misleading information;

        Submitting fraudulent documentation;

        Attempting to obtain a regulated product unlawfully; or

        Any other unlawful purpose.

Ballistic reserves the right to suspend or cancel any transaction where fraudulent, suspicious or unlawful activity is suspected.

14.  CANCELLATIONS AND REFUNDS

Requests for cancellation must be submitted to Ballistic as soon as possible.

Where a regulated product has entered a legal, licensing, transfer or administrative process, cancellation and refund arrangements may be subject to the circumstances of the transaction and applicable law.

Where a refund is legally permitted, refunds will be processed using the applicable refund procedure and, where reasonably possible, the original payment method.

Certain administrative, processing, transfer, delivery or other costs may be nonrefundable where such costs have already been incurred, subject to applicable consumer law.

Nothing in these Terms & Conditions excludes any rights that a consumer may have under applicable South African consumer protection legislation.

15.  RETURNS

Returns of firearms, ammunition and regulated products are subject to applicable legislation and Ballistic's return procedures.

A regulated product may not simply be returned or transferred between parties outside the procedures permitted by law.

Customers must contact Ballistic before attempting to return any regulated product.

Unauthorised returns or transfers will not be accepted.

16.  PRODUCT INFORMATION

Ballistic makes reasonable efforts to ensure that product descriptions, photographs, specifications, prices and availability information displayed on the website are accurate.

However, manufacturers may change specifications, packaging, appearance or product configurations without notice.

Photographs may be for illustrative purposes and may not always represent the exact packaging or configuration supplied.

Customers should contact Ballistic before purchasing if they require confirmation of a particular specification.

17.  CUSTOMER RESPONSIBILITY

The customer is responsible for ensuring that:

        All information supplied to Ballistic is accurate;

        All documentation supplied is genuine and valid;

        The customer is legally entitled to purchase and possess the relevant product;

        The customer complies with all applicable firearm and ammunition laws;

        Firearms and ammunition are stored and handled lawfully;

        The customer does not allow an unauthorised person to access or possess regulated products; and

        The products are used only for lawful purposes.

18.  SAFE AND LAWFUL USE

Ballistic does not authorise or encourage the unlawful use, modification, transfer or possession of firearms, ammunition or related products.

Customers are responsible for complying with all applicable laws, regulations, licence conditions and safety requirements.

Firearms must always be handled, stored, transported and used responsibly and in accordance with applicable law and manufacturer instructions.

19.  WEBSITE USE

Customers agree not to:

        Attempt to gain unauthorised access to the website;

        Interfere with website security;

        Submit fraudulent information;

        Use automated systems to abuse the website;

        Copy or reproduce website content without permission; or

        Use the website for unlawful purposes.

Ballistic reserves the right to restrict or terminate access to the website where misuse is suspected.

20.  PRIVACY AND CUSTOMER INFORMATION

Ballistic may collect and process customer information required to process orders, conduct compliance checks, communicate with customers, process payments, arrange delivery or collection, maintain legally required records and comply with applicable legislation.

Customer information will be handled in accordance with Ballistic's Privacy Policy and applicable South African data-protection legislation.

Where disclosure is required by law, Ballistic may provide relevant information to SAPS, government authorities, regulators, payment providers, authorised service providers or other appropriate parties.

21.  LIMITATION OF LIABILITY

To the extent permitted by South African law, Ballistic will not be liable for losses arising from:

        Delays caused by SAPS or other governmental authorities;

        Delays in firearm licence applications;

        Regulatory decisions outside Ballistic's control;

        Courier or transportation delays;

        Product availability issues;

        Incorrect information supplied by the customer;

        Failure by the customer to provide required documentation; or

        The customer's unlawful, negligent or improper use of a product.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

22.  COMPLIANCE WITH SOUTH AFRICAN LAW

All regulated-product transactions conducted through Ballistic are subject to applicable South African legislation.

In particular, firearm and ammunition transactions are subject to the Firearms Control Act 60 of 2000, the applicable Firearms Control Regulations and other relevant legislation.

Where legislation imposes requirements that differ from these Terms & Conditions, the applicable law will prevail.

23.  RIGHT TO REFUSE A SALE

Ballistic reserves the right to refuse, suspend or cancel any transaction where:

        The customer cannot establish the required legal entitlement;

        Required documentation is missing or invalid;

        The transaction may contravene applicable legislation;

        The customer's information cannot be satisfactorily verified;

        Fraud or suspicious activity is suspected;

        The product is unavailable;

        The payment cannot be verified; or             Ballistic reasonably determines that completing the transaction would create a legal, regulatory or safety concern.

24.  INTELLECTUAL PROPERTY

All website content, including logos, trademarks, photographs, graphics, product descriptions, text and other material, remains the property of Ballistic Guns & Ammo or its respective licensors unless otherwise stated.

No content may be reproduced, copied, distributed or commercially exploited without prior written permission.

25.  CHANGES TO THESE TERMS

Ballistic reserves the right to amend these Terms & Conditions from time to time.

The updated version will be published on the website and will apply from the effective date stated in the updated Terms & Conditions.

Customers should review these Terms & Conditions before placing an order.

26.  GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising from the use of the website or a transaction with Ballistic will be subject to the jurisdiction of the appropriate courts of South Africa, subject to any mandatory rights or dispute-resolution mechanisms provided by applicable law.

        They understand that firearms and ammunition are regulated products;

        They understand that an online order does not automatically authorise possession or transfer of a firearm or ammunition;

        They agree to provide accurate and genuine documentation when requested;

        They understand that Ballistic may conduct verification and compliance checks;

        They understand that Ballistic may refuse or cancel a transaction where legal requirements are not satisfied; and

        They agree to comply with all applicable South African laws and regulations.
