BALLISTIC GUNS & AMMO REFUND & CANCELLATION POLICY Effective Date: 13 August 2026

1. INTRODUCTION

This Refund & Cancellation Policy sets out the conditions under which Ballistic Guns & Ammo ("Ballistic", "we", "us" or "our") accepts cancellations, returns, exchanges and refunds for products purchased through our website, online store, telephone, email or physical premises.

Because Ballistic supplies firearms, ammunition and other regulated products, all refunds, cancellations, returns and transfers are subject to applicable South African legislation and regulatory requirements.

Nothing in this Policy is intended to limit or exclude any consumer rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 ("CPA") or any other applicable legislation.

 

2. REGULATED PRODUCTS

Firearms, ammunition and certain firearm components are regulated products.

A customer may not return, transfer, sell, deliver or otherwise dispose of a regulated product to another person except in accordance with applicable South African law.

Accordingly, the normal return procedures applicable to ordinary retail products may not apply to firearms and ammunition.

Ballistic reserves the right to require additional documentation and verification before processing any return, cancellation or refund involving a regulated product.

 

3. FIREARM ORDERS

Submitting an order or making payment for a firearm does not automatically result in the firearm being transferred to the customer.

A firearm may only be released or transferred once all applicable legal requirements have been satisfied.

Where a firearm licence application is required, Ballistic does not guarantee that the application will be approved.

Licence applications and decisions made by SAPS or other authorities are outside Ballistic's control.

 

4. CANCELLATION BEFORE PROCESSING

A customer may request cancellation of an order before Ballistic has completed processing or commenced any applicable regulatory or administrative procedure.

Cancellation requests must be submitted in writing to:

        Full name;

        Order number;

        Contact details;

        Product ordered; and

        Reason for cancellation.

Ballistic will assess the cancellation request and confirm whether cancellation is possible.

 

5. FIREARM LICENCE REFUSAL

If a customer's firearm licence application is refused by the relevant authority, the customer must contact Ballistic as soon as reasonably possible.

The consequences of the refusal may depend on:

        The status of the firearm;

        Whether the firearm has already been transferred;

        Whether the firearm remains in Ballistic's possession;

        Administrative or regulatory costs already incurred;

        Any applicable legal requirements; and

        The terms agreed with the customer.

A firearm licence refusal does not automatically create an unrestricted right to a refund of all amounts paid.

Ballistic will assess each situation individually and in accordance with applicable law.

 

6. AMMUNITION

Due to the regulated nature of ammunition, returns and refunds are subject to applicable legislation and Ballistic's verification procedures.

Ammunition will generally not be accepted for return merely because a customer has changed their mind, ordered the incorrect calibre or no longer requires the product, unless Ballistic is legally required to accept the return.

Where ammunition is defective, damaged or incorrectly supplied, the customer must contact Ballistic before attempting to return the product.

Customers must not send ammunition back to Ballistic without first receiving instructions from us.

 

7. FIREARM RETURNS

Firearms may not be returned using ordinary courier or postal services unless such transportation is lawful and appropriately authorised.

Customers must contact Ballistic before attempting to return a firearm.

Any firearm return, transfer or movement must comply with all applicable firearm legislation, licence conditions and transportation requirements.

Ballistic may require the firearm to be returned through an authorised dealer, gunsmith, transporter or other legally authorised process.

 

8. DEFECTIVE OR DAMAGED PRODUCTS

If a product is defective, damaged or does not correspond with the product purchased, the customer must notify Ballistic as soon as reasonably possible.

The customer may be required to provide:

        Order number;

        Proof of purchase;

        Photographs or other evidence of the issue;

        Product details; and

        Any other information reasonably required to investigate the complaint.

Where the product is found to be defective and the customer is entitled to a remedy under applicable law, Ballistic may, depending on the circumstances and applicable legal requirements:

        Repair the product;

        Replace the product;

        Provide a refund; or

        Provide another remedy required by law.

 

9. INCORRECT PRODUCT SUPPLIED

If Ballistic supplies a product that differs from the product ordered, the customer should notify us immediately.

Ballistic will investigate the matter and, where appropriate, arrange for the incorrect product to be returned through a lawful method and provide the appropriate remedy.

For regulated products, the return and replacement process will be handled in accordance with applicable legislation.

 

10. CHANGE OF MIND

Subject to the rights provided by applicable consumer legislation, refunds for products returned solely because the customer has changed their mind are not guaranteed.

For firearms and ammunition, additional restrictions apply because these products are regulated.

Ballistic may refuse a change-of-mind return where accepting the return would contravene applicable legislation or regulatory requirements.

 

11. ONLINE ORDERS

An online order is subject to Ballistic's acceptance and verification procedures.

Ballistic may cancel an order where:

        The product is unavailable;

        The customer's information cannot be verified;

        Required documentation is not provided;

        The customer is not legally entitled to purchase the product;

        A firearm licence or required authorisation is refused;

        Payment cannot be verified;

        Fraud or suspicious activity is detected;

        The transaction may contravene applicable legislation; or

        Completion of the transaction is otherwise prohibited or impractical.

Where an order is cancelled and a refund is legally due, Ballistic will process the refund in accordance with this Policy and applicable law.

 

12. REFUND METHOD

Approved refunds will generally be processed using the original payment method where reasonably possible.

The timing of a refund may depend on:

        Ballistic's internal processing;

        The payment provider;

        The customer's bank; and

        Any applicable regulatory or verification requirements.

Ballistic is not responsible for delays caused solely by a customer's bank or third-party payment provider.

 

13. PAYMENT PROCESSING FEES

Where a transaction is cancelled or refunded, payment processing fees or other thirdparty charges may be treated in accordance with the applicable payment provider's terms and applicable South African law.

Ballistic will not deduct any amount from a refund where such deduction is prohibited by law.

 

14. DELIVERY AND SHIPPING COSTS

Where a product is returned because Ballistic supplied the wrong product or because the product is defective, the treatment of delivery or return costs will be determined in accordance with applicable law and the circumstances of the transaction.

Where a return is requested for a reason unrelated to a defect or Ballistic's error, the customer may be responsible for applicable delivery or return costs, subject to applicable consumer law.

Regulated products may require specialised transportation arrangements.

 

15. PRODUCTS DAMAGED AFTER DELIVERY OR COLLECTION

Customers are responsible for taking reasonable care of products after lawful delivery or collection.

Where a product is damaged after delivery or collection due to misuse, negligence, unauthorised modification or improper storage, Ballistic may refuse a refund or replacement to the extent permitted by law.

This does not affect any rights the customer may have in respect of an underlying manufacturing defect.

 

16. ACCESSORIES AND NON-REGULATED PRODUCTS

For accessories and other non-regulated products, returns may be accepted subject to:

        Proof of purchase;

        The applicable consumer legislation;

        The condition of the product;

        Whether the product has been used or damaged; and

        Any applicable manufacturer warranty.

Products should, where reasonably possible, be returned with their original packaging, accessories, manuals and documentation.

 

17. SPECIAL ORDERS

Products specially ordered, imported, customised or sourced specifically for a customer may be subject to different cancellation and refund conditions.

The customer will be informed of any applicable special-order conditions before the order is confirmed where reasonably possible.

Nothing in this section limits mandatory consumer rights.

 

18. FRAUDULENT TRANSACTIONS

Ballistic reserves the right to place transactions on hold or cancel transactions where fraud, identity theft, payment fraud or other suspicious activity is suspected.

Where appropriate, Ballistic may report suspected fraudulent or unlawful activity to the relevant authorities.

Refunds relating to fraudulent transactions may be subject to investigation and verification.

 

19. NO UNAUTHORISED RETURNS OF FIREARMS OR AMMUNITION

Customers must not send firearms, ammunition or other regulated products back to Ballistic without first contacting us and receiving written instructions.

Unauthorised transportation or transfer of regulated products may be unlawful.

Ballistic will not accept responsibility for regulated products sent to us through an unauthorised or unlawful method.

 

20. WARRANTY CLAIMS

Manufacturer warranties may apply to certain products.

Where a product is covered by a manufacturer's warranty, Ballistic may assist the customer in submitting a warranty claim.

Warranty claims are subject to the applicable manufacturer's warranty terms.

Nothing in this Policy removes any statutory consumer rights that apply to the customer.

 

21. CONSUMER RIGHTS

This Policy must be read together with applicable South African consumer-protection legislation.

Where a mandatory legal right provides a customer with a right to return, repair, replacement or refund, Ballistic will comply with the applicable legal requirement.

Where this Policy conflicts with a mandatory provision of applicable law, the applicable law will prevail.

 

22. HOW TO REQUEST A REFUND

        Full name;

        Order number;

        Proof of purchase;

        Product name;

        Reason for the refund or return request; and

Ballistic will assess the request and advise the customer of the next steps.

 

23. REFUND PROCESS

Once a refund has been approved:

1.     Ballistic will confirm the approved refund amount.

2.     Where applicable, the product will be returned using an approved and lawful method.

3.     Ballistic will inspect the product where necessary.

4.     The refund will be processed using the applicable payment method.

5.     The customer will be notified once the refund has been processed.

The actual time for the funds to reflect in the customer's account may depend on the payment provider or bank.

 

24. POLICY CHANGES

Ballistic reserves the right to amend this Refund & Cancellation Policy from time to time.

The latest version will be published on the website with the applicable effective date.

By placing an order through the Ballistic Guns & Ammo website, the customer acknowledges that they have read and understood this Refund & Cancellation Policy and understand that firearms, ammunition and other regulated products are subject to additional legal and regulatory requirements.

Ballistic Guns & Ammo reserves the right to refuse any return, cancellation or refund were doing so would contravene applicable South African legislation.
